Transcripts recently released during the preliminary hearing for Bill Cosby’s sexual assault charges reveal that Cosby had a romantic and business interest in accuser Andrea Constand. The police report also revealed Andrea Constand changed dates, details, and withheld information about the alleged incident against Cosby. Including information such as dates, surrounding circumstances, gifts, and post contact after the alleged incident. The police report also showed Constand had sexual contact and relationships with males prior to Cosby.
On May 24, 2016, Bill Cosby appeared in court for a preliminary hearing, at the hearing prosecution where had to prove they have enough evidence to move forward with a trial. Montgomery County District Attorney Kevin Steele relied on “hearsay”and detectives’ recollections about Constand’s statements. Cosby’s legal team argued allowing hearsay testimony was a denial of Cosby’s right to confront his accuser and “a complete denial of this defendant’s due process rights.” Cosby’s lawyer also argued that while Cosby should have the right to confront his accuser, Constand did not have to appear for the hearing.
In Pennsylvania hearsay is admissible for a prima facie case at preliminary hearings, however, there is a case-law in the PA Supreme court challenging that practice. Cosby’s lawyers have appealed to those grounds. The hearsay testimony that was allowed into evidence at the preliminary hearing came from two detectives who were not present for the entire police interview 12 years ago. Judge Elizabeth McHugh ruled Cosby must go to trial for allegedly drugging and sexually assaulting Constand, at his home in Pennsylvania, in January 2004.
After ending employment with Temple University in March 2004, as the Director of Basketball Operations, Constand, then 31, moved back to Canada to live with her parents.
From the police interview, we learned that Constand earned a degree in Communication from the University of Arizona, after graduating in 1999, Constand lived in Italy, Los Angeles, Philadelphia, and Toronto. She was enrolled in massage therapy school and while in school, Constand sought guidance from a psychotherapist to discuss life and career issues after school, and what her mother described as post-traumatic stress. Constand also reveals her brother- in-law is a police officer in Toronto.
Timeline & highlights
On Jan. 13, 2005, nearly a year of being unemployed and living with her parents, Constand, 31, had a “flashback” and told her mother Cosby drugged and sexually assaulted her when she worked at Temple.
After informing her mother, Constand attempted to contact civil attorneys in Philadelphia and went to police authorities in Canada.
Feb 2016: Attached court records explained why Constand retained a civil attorney before talking to Montgomery County police.
Autumn Jackson first came to media attention in 1997 for her extortion attempt against comedian Bill Cosby after his son Ennis was murdered. Jackson had threatened to go to the tabloids with her claim to be Cosby’s illegitimate child unless Cosby paid her $40 million. Cosby denied the claim, Autumn’s mother, Shawn Thompson Upshaw is one of the accusers alleging she was assaulted by Cosby. Autumn is not Cosby’s daughter and was charged and sentenced to jail for extortion. It was said if Autumn had used an attorney to ask for money, it would not be extortion.
During her first interview with Canadian police, Constand reported that Cosby assaulted her in March 2004 and that the incident happened after a group dinner party in Chinatown.
Later in an interview with Montgomery County police officers, Constand changed her dates and told police that the incident happened between mid-January- mid-February 2004 after Cosby invited her for dinner at his residence.
In the police report, Constand initially left out that she and Cosby had previous sexual contact, after interviewing Cosby the police re-interviewed Constand asking her about previous statements.
The first encounter with Cosby was dinner served by the fireplace at his home, where Constand was the only guest and she had a glass of wine and rare expensive cognac with her meal. After dinner, Constand gave Cosby a few gifts.
Did you have any sexual encounter with Cosby that you did not tell us?
Constand said “Yes.”
Constand maintains she only had a business “mentoring relationship” with Cosby, however, she was never invited to dinner or events when the wife or family was present.
Mentoring Relationship Included:
• Shopping Spree at King of Prussia Mall for expensive hair dryer $200-250
• 3 cashmere sweaters
• Cognac by the fireplace
• Hotel room and travel
• Tongue kissing, petting
• Trips to NY and Connecticut
• Mentor made a meeting happen for the broadcasting job, Cosby arranged for Constand to meet with a broadcast executive in the hopes of meeting NBC Sports and Olympics executive Dick Ebersol, however, the executive met with Constand and decided she was not a good fit at the time to be a sports broadcaster for the Olympics.
Throughout the police investigation, we learn police issued a search warrant for Cosby’s home, and no drugs were found. During his interview with police in NY, Cosby was checked for drugs and the police tested the Benadryl pills he had on him and confirmed them to be Benadryl pills.
Constand is the only accuser who has been able to take Cosby to criminal court, even though he settled with her for millions in 2006. Cosby is now suing Constand, her attorney, and Constand mother seeking his settlement money back.
Former Montgomery County District Attorney Bruce Castor never charged Cosby in 2005 and still stand by his decision based on the reports and facts surrounding the alleged assault.
In fact, Castor said Constand and her mother “had committed a felony.” Castor said that without evidence to corroborate Constand’s story, criminal justice was not realistic. He did want to see her become a millionaire and made it possible to take away Cosby’s rights and Andrea sued Cosby for millions of dollars.
Castor is being sued by Constand now because he said her story changed.
Castor on Constand “Inky: Cosby victim told police MUCH different than she told the court in her lawsuit. First, I saw that in a story. Troublesome for the good guys. Not Good.”
What the police report reveals…is inconsistencies, lots of cross outs, lots of add-ins, and that Constand maintained a relationship with Cosby a year after the alleged assault. Constand interviewed with the police at least three times, Constand even returned to the “scene of the crime” to have dinner.
